The University of Utah Greek Judiciary met on February 26, 2002, to hear the charges contained in a formal complaint brought against the Kappa Sigma fraternity by Cory Peterson, IFC president, on behalf of the University of Utah Greek Council. The complaint states that on the evening of Saturday, Jan. 19, 2002, a social gathering took place at the Kappa Sigma house that violated the Greek Council Constitution and the Greek Council Uniform Party Policy.
The Greek Judiciary acknowledges that the Kappa Sigma fraternity pleads guilty to the charges in the Formal Complaint.
Following careful deliberations the Greek Judiciary rendered the following decision:
1. Kappa Sigma will be declared alcohol-free, and that the fraternity will prepare management guidelines for ensuring that Kappa Sigma abide by this decision. A statement of implementation shall be submitted to the Office of the Vice President for Student Affairs no later than March 29, 2002.
2. Before the conclusion of Spring Semester of 2002, the Kappa Sigma fraternity will implement an alcohol training program for the chapter under the direction of Kappa Sigma International. Completion of this program will be mandatory for all Kappa Sigma members, with formal training completed within the first six months of actual membership. This requirement will continue each semester, indefinitely.
3. The chapter president, under the direction of the chapter adviser, will submit to the vice president for student affairs a detailed listing of all self imposed sanctions and a formal letter of commitment to the University of Utah. This communication will be completed no later than March 29, 2002.
4. For Spring and Summer semesters of 2002, the Kappa Sigma fraternity will be prohibited from holding any and all social events, including (but not limited to) exchanges, formals and parties. However, Kappa Sigma will be permitted to hold spring recruitment events and their annual philanthropic events during Philanthropy Week.
5. In accordance with the Uniform Party Policy of the Greek Council, the Greek Judiciary endorses the violation fines totaling $ 8,150.00 levied against the Kappa Sigma fraternity.
6. Finally, the Greek Judiciary hereby places Kappa Sigma fraternity on formal probationary status for a period of one year, effective immediately. Furthermore, it is understood that if Kappa Sigma is found guilty of any further violation of the Greek Constitution that the Judiciary will immediately recommend that the university withdraw recognition from Kappa Sigma and that Kappa Sigma International revoke the chapter’s charter.
